Conflicts arise all the time over the course of daily life. Sometimes those disagreements can be settled easily without the involvement of outside help and there are other times when reaching an amicable agreement without assistance simply is not possible for a variety of reasons. If you find yourself in this situation, consider alternative dispute resolution before taking your case to court.

Alternative dispute resolution (ADR) is usually cheaper, less time consuming, and less formal than a trial. With the high costs of litigation and the backlog of dockets in civil courts, traditional lawsuits are becoming more impractical for many businesses and individuals.

The Khorozian Law Group, located in Fort Lee, provides alternative dispute resolution services, which include arbitration and mediation, to clients throughout New Jersey.

Mediation is a process in which an unbiased third-party facilitates negotiations between two other parties. The goal of mediation is to help the two disputing sides reach a mutually acceptable settlement. The mediator does not make the decision that determines the outcome of the case. Rather, the parties – with the assistance of their attorneys – work with a mediator toward a solution with which they are comfortable.

Mediation is often used to amicably resolve disputes between parties that have an ongoing relationship (business and/or personal) where the primary obstacle to settlement is either personal or emotional. A mediator helps to assist the two parties into finding a settlement where a mutually beneficial relationship can continue to exist.

Arbitration is a process in which a neutral third-party considers evidence presented by the polarized parties then makes a decision within the settlement. This new agreement may be binding, according to statute, rule, or the prior agreement of the parties. The arbitrator’s decision, as opposed to a mediator, determines the final outcome of a case. This process is not as formal as a trial or court hearing but is more formal than a negotiation or mediation.

The Khorozian Law Group has extensive experience representing clients in mediation and arbitration proceedings. Whichever kind of alternative dispute resolution process is used, our attorneys will advise clients regarding the drafting of appropriate dispute resolution clauses, selection of a neutral third-party, as well as presentation of the case, achieving satisfactory results. Our goal is to provide services to alleviate a dispute to prevent a costly and time-consuming lawsuit.
