Mediation

Mediation is a process in which an unbiased third-party facilitates negotiations between two other parties. The goal of mediation is to help the two disputing sides reach a mutually acceptable settlement. The mediator does not make the decision that determines the outcome of the case. Rather, the parties – with the assistance of their attorneys – work with a mediator toward a solution with which they are comfortable.

Mediation is often used to amicably resolve disputes between parties that have an ongoing relationship (business and/or personal) where the primary obstacle to settlement is either personal or emotional.  A mediator helps to assist the two parties into finding a settlement where a mutually beneficial relationship can continue to exist.

Arbitration

Arbitration is a process in which a neutral third-party considers evidence presented by the polarized parties then makes a decision within the settlement. This new agreement may be binding, according to statute, rule, or the prior agreement of the parties. The arbitrator’s decision, as opposed to a mediator, determines the final outcome of a case. This process is not as formal as a trial or court hearing, but is more formal than a negotiation or mediation.
